Medical Leave Laws in Costa Mesa

Employees facing a need for medical leave can be provided up to 12 weeks of unpaid, job-protected leave per the federal Family and Medical Leave Act (FMLA). This also covers conditions such as pregnancy and adoption. Under the FLMA, employees are protected from unlawful firing or retaliation. The Family and Medical Leave Act applies to employees who need to:

  • Take medical leave for yourself
  • Care for an ill family member
  • Bond with a new child
  • Participate in an event due to a family member’s military status or deployment

California employees are also protected by the California Family Rights Act (CFRA), which gives employees many of the same benefits of the FMLA, as well as:

  • Treatment of domestic partners is equal to that of a spouse
  • Grants baby or new child bonding to both parents, regardless of gender, after the birth or arrival of the child
  • Expands the medical conditions covered by the FMLA

These two acts are in place to protect employees and their loved ones. If you have been denied medical leave at your place of employment, a Costa Mesa medical leave lawyer will fight for your rights.

Medical Leave Cases in Costa Mesa

Not all medical needs and emergencies are physical or even visible to others, let alone your employer. A recent 2025 study showed that in the past two years, one in three workers took an extended leave of absence due to mental health issues.

The rights employees have gained at both the federal and state levels have helped to push the acceptance of medical leave to cover these invisible or silent conditions as well. Sadly, this can still be a point of contention for some employers, leading them to deny claims in bad faith.

Your employer might be in direct violation of federal or state medical leave laws if they:

  • Denied your leave based on false statements
  • Harassed, demoted, or otherwise punished you for requesting or taking medical leave.
  • Terminated your employment for requesting or upon return from medical leave

It is important to know whether your employment is considered at-will or not. In California, employment may be terminated at the will of either the employee or the employer without penalty. This makes documentation vital in a medical leave case. Getting in writing the reasons for leave denial or proof of discrimination due to your specific medical leave request will help build your case, despite the at-will status of your employer.

Per the California Division of Labor Standards Enforcement, employees who feel they’ve faced unwarranted termination, harassment, or discrimination due to their race, religion, medical condition, marital status, sexual orientation, or denial of medical leave should contact the Department of Fair Employment and Housing.

Pregnancy is treated with special care under California law. Employees expect to have special protections in the state and cannot be discriminated against or harassed:

  • Due to pregnancy
  • Due to the intention to get pregnant
  • Due to having taken or the intention to take leave for pregnancy or baby bonding

There are three major laws that protect pregnant and expecting employees in the state of California:

  • Pregnancy Disability Leave Law. Employers in California with five or more employees are required to give up to 17 weeks of leave for pregnancy or childbirth-related disabilities. This is separate from any bonding leave.
  • California Family Rights Act. Employers in California with fifty or more employees are required to give up to 12 weeks of family care and medical leave for events such as after a baby is born, or after adoption or foster care placement in a household. Under the CFRA, both mothers and fathers are to be allotted this time for bonding as well as to care for any health conditions common in the weeks following the birth of a baby.
  • Fair Employment and Housing Act. Employer must accommodate reasonable requests, not limited to additional leave, once other time has been used. This covers any time needed for ongoing medical issues or disability resulting from pregnancy or childbirth.

If you feel your medical leave was wrongfully denied or that you were discriminated against at work while pregnant, our medical leave lawyers at The California Employment Counsel, APC, will work to ensure your employer is held accountable for any physical or emotional harm inflicted during such a vulnerable time.
